Resolved Question: Is foreclosure a good idea?
heres the deal…
we are upside down in our home that is only in my husbands name and we cannot sell our house in this economy. we have had 1 offer in over a year of having it on the market. We are thinking about letting it go and taking the hit. We can afford it its just we are stuck here and want out. My husband makes 165000$ a year(in oklahoma) and has a $60000 car loan that will be paid off soon and another car loan that will be paid off soon as well.

if we let the house go we will be able to rent a nice house for a couple years and be able to buy things we have not been able to afford in the past and save money for our future ect. so just by what i have read we should be able to bounce back quickly and get a house in 5 years. (I understand that it wont fall off for 7 years) but we have termites and need the roof replaced and owe homeowner dues of 800$ so it just seems logical to take the hit. we tried a short sale with the only offer we had but our lending company wont let us do a short sale!

I simply cannot justify giving up a car that i like and that will be paid off and putting it towards a house that i dont like and that i am upside down and that will be paid off in 25 years. that just means i will have to buy another car no matter what the price and be in debt on a car again. my goal is to have everything paid off beofre i buy another house not go into debt to get rid of a house.

It’s time again for the annual ‘Stella Awards’! For those unfamiliar with these awards, they are named after 81-year-old Stella Liebeck who spilled hot coffee on herself and successfully sued the McDonald’s in New Mexico , where she purchased coffee. You remember, she took the lid off the coffee and put it between her knees while she was driving. Who would ever think one could get burned doing that, right? That’s right; these are awards for the most outlandish lawsuits and verdicts.

Kathleen Robertson of Austin ,
Texas was awarded $80,000 by a jury of her peers after breaking her ankle tripping over a toddler who was running inside a furniture store. The store owners were understandably surprised by the verdict, considering the running toddler was her own son.

* SIXTH PLACE *

Carl Truman, 19, of Los Angeles , California won $74,000 plus medical expenses when his neighbor ran over his hand with a Honda Accord. Truman apparently didn’t notice there was someone at the wheel of the car when he was trying to steal his neighbor’s hubcaps.

* FIFTH PLACE *

Terrence Dickson, of Bristol , Pennsylvania , who was leaving a house he had just burglarized by way of the garage. Unfortunately for Dickson, the automatic garage door opener malfunctioned and he could not get the garage door to open. Worse, he couldn’t re-enter the house because the door connecting the garage to the house locked when Dickson pulled it shut. Forced to sit for eight, count ‘em, EIGHT days and survive on a case of Pepsi and a large bag of dry dog food, he sued the homeowner’s insurance company claiming undue mental Anguish. Amazingly, the jury said the insurance company must pay Dickson $500,000 for his anguish. We should all have this kind of anguish. Keep scratching. There are more…..

Jerry Williams, of Little Rock, Arkansas, garnered 4th Place in the Stella’s when he was awarded $14,500 plus medical expenses after being bitten on the butt by his next door neighbor’s beagle - even though the beagle was on a chain in its owner’s fenced yard. Williams did not get as much as he asked for because the jury believed the beagle might have been provoked at the time of the butt bite because Williams had climbed over the fence into the yard and repeatedly shot the dog with a pellet gun.

Pick a new spot to scratch, you’re getting a bald spot..

* THIRD PLACE *

Amber Carson of Lancaster , Pennsylvania because a jury ordered a Philadelphia restaurant to pay her $113,500 after she slipped on a spilled soft drink and broke her tailbone. The reason the soft drink was on the floor: Ms. Carson had thrown it at her boyfriend 30 seconds earlier during an argument. What ever happened to people being responsible for their own actions?

Only two more so ease up on the scratching….

*SECOND PLACE*

Kara Walton, of Claymont , Delaware sued the owner of a night club in a nearby city because she fell from the bathroom window to the floor, knocking out her two front teeth. Even though Ms. Walton was trying to sneak through the ladies room window to avoid paying the $3.50 cover charge, the jury said the night club had to pay her $12,000 …. oh, yeah, plus dental expenses. Go figure.

Ok. Here we go!!

* FIRST PLACE *

This year’s runaway First Place Stella Award winner was: Mrs. Merv Grazinski, of Oklahoma City , Oklahoma , who purchased new 32-foot Winnebago motor home. On her first trip home, from an OU football game, having driven on to the free-way, she set the cruise control at 70 mph and calmly left the driver’s seat to go to the back of the Winnebago to make herself a sandwich. Not surprisingly, the motor home left the freeway, crashed and overturned. Also not surprisingly, Mrs. Grazinski sued Winnebago for not putting in the owner’s manual that she couldn’t actually leave the driver’s seat while the cruise control was set. The Oklahoma jury awarded her, are you sitting down?
$1,750,000 PLUS a new motor home. Winnebago actually changed their manuals as a result of this suit, just in case Mrs. Grazinski has any relatives who might also buy a motor home.

Are we, as a society, getting more stupid…..

Resolved Question: college appeal letter…your opinion please?
I have to write an appeal letter because I was denied readmission. The story is below in my appeal letter, but I need to know if it is too much or what? I’m confused on if I need to add more or take some away. Does it sound like I’m begging??? I haven’t edited any so there may be some gramatical errors.

To Whom It May Concern:

This letter is to appeal the denial of my re-admission to The University of Texas at San Antonio. It has come to my attention that I was denied admission due to my low GPA at The University of Oklahoma Norman Campus. I would like the admissions department to reconsider their decision once they have reviewed the situation that resulted in the low GPA at the previous University.
I was a student at UTSA for four years, and was an average student. My cousin and I are the first of my family to attend college, and UTSA is the college we both chose. I greatly enjoyed UTSA and would love to attain my bachelor’s from such a well known university. I have confidence that the great faculty and staff can guide me to the career I desire as I experienced straight out of high school. In return, I will devote my studies and strive to be a better student than before.
I married a US Navy petty officer which resulted in us moving to Oklahoma City, Oklahoma where he was stationed at Tinker AFB. I was granted admission into The University of Oklahoma Norman Campus for the fall semester of 2007. I was excited, and relieved that I had no issues continuing my education. However, it was disappointing that nearly half of my credits did not transfer. I decided to take only once course. We were in the process of buying our first home together, and adjusting to the state. I found a job working at OU Health Science Center in accounting department, which I extremely enjoyed working in the field I desired to study.
It was not long before my husband and I found out we were expecting. It was very hard for me to cope with everything, as this was the first time I was away from home. Soon after, my husband told me had he decided to stay in the service he would be deployed on a ship for an unknown amount of time. This took a toll not only on the future of my family, but also my marriage and the health of my unborn baby and me. We soon decided that my husband’s presence for the birth of my daughter and her life was much more important. It was at that time that we decided we would separate from the military and start our family and future back in San Antonio, Texas. We thought that would be the answer to all our problems, but we were mistaken. At that time, I missed the deadline to drop my course by a day or two. I was told it would not transfer back to UTSA, and I felt that I did not need to complete the class. I thought the payment of the course and time was all that I lost. Now, that I know that was not all that was lost, I deeply regret taking the easy way out.
We moved back to San Antonio in the summer of 2008, and are completely settled in. I wished to take classes as soon I returned San Antonio. I had to be honest with myself, and decided I needed to wait. I knew I could not take on more than I could handle, as I learned my lesson last time around. It has now come my time to continue my education and plan a better life for my family. I now have a bigger and better reason to accomplish my life time goal, and “failure is not an option” is my motto.
I am grateful for the work experience in Oklahoma, because I realized that is something that I do not want as my career. I have now decided that I will follow my dream as a child to pursue my education as a math teacher.
I have the potential and desire to be that student that the university will be proud of. With the universities assistance I would like to accomplish my life time goal and attain a bachelor’s degree from The University of Texas at San Antonio. With all do respect, I would like the university to reconsider my application once more.

Six states are getting the OK to write their own prescriptions for ailing schools under the Bush administration’s signature education law.

It’s a softening from how No Child Left Behind currently works — with schools having to take certain steps at specific times for missing math and reading testing goals. Critics have complained that the approach is too rigid and treats schools the same regardless of whether they miss the mark by a little or a lot.

The states getting more freedom under a pilot program are Florida, Georgia, Indiana, Illinois, Maryland and Ohio. Education Secretary Margaret Spellings made the announcement during a speech Tuesday in Austin, Texas.

The states that won approval have come up with plans to more closely tailor solutions to individual schools’ problems and focus resources on schools in the worst shape.

“We expect to see a closer fit between the causes of school underperformance and a focused attention at repairing those sources of failure,” said Margaret Raymond, director of an education think tank at Stanford University and the chair of a panel that reviewed the state proposals.

Examples of changes the states plan to make include requiring schools to offer tutoring earlier than is currently called for and a greater reliance, in Indiana for example, on testing throughout the year to catch academic weak spots.

In Florida, schools with low-performing students will likely be assigned teachers who have experience teaching similar students successfully.

Maryland is placing more emphasis on training principals. It’s common under the law for failing schools to replace their principals. “We think principal leadership is key. It’s not just changing a principal, it’s ensuring principals have the necessary skill sets,” said Maryland schools superintendent Nancy Grasmick.

In Georgia, the state is spelling out that schools can become charter schools, which are public but operate with broad independence, earlier than is currently called for, said the state’s superintendent of schools, Kathy Cox.

Some critics worry the changes, specifically the focus on the worst-performing schools, will take the pressure off schools that are generally doing well but having trouble with one group of students — such as a minority group or kids with disabilities.

“I don’t think it’s taking the pressure off. I think it’s allowing focus,” Cox said.

Spellings has said up to 10 states will be allowed to try to participate in the pilot program. The Education Department plans to review additional state proposals this fall.

The six states that won approval were among 17 that sought it.

The states that didn’t win approval were Alaska, Arkansas, Louisiana, New Jersey, New York, North Dakota, Oklahoma, Pennsylvania, South Carolina, Tennessee and Virginia.

Spellings said in an interview that the efforts by the states that won approval to try new approaches will be closely watched and will shape any future rewrite of the six-year-old No Child law.

“We’re trying to set the table for a strong and sensible reauthorization,” Spellings said. “We’re going to learn some things.”

Resolved Question: I need help findng something.. Please it’s REALLY important to me and my sister Amber…?
Ok so me and my sister Amber have wanted a Siberian Husky puppy since we were little babies and knew what the breed looked like and what it was called. Well we actually found a couple who’s siberian huskies just had a litter of 5. The couple wanted $375 for them becuase they were doing a project for their house to remodel it so we talked to our mom she said it was okay that we got her.(the puppy) if we came up with the money for gas and to pay for the puppy. We called them and told them which one we wanted and they said “ok we’ll hold this puppy for you and your sister until you can get down here and pay a little bit of money so we will take it off the for sale list.” But they live in Oklahoma City, Oklahoma almost near Edmond, like maybe 10 minutes away. We called last weekend and said hey you know we have some money we will get our cousin to take us there so we can pay for the puppy they were already 3 weeks old so 3 more weeks til we could go get her and take her home. Well this past sunday 3/8/09 I called and said we’ll be there to pay for her as soon as our cousin gets here cuz we had almost $100. The guy says “we sold the dog you wanted there is only two left the white female and the black and white male.” After me and my sister heard him say that we just started bawling and crying because we just fell in love with that puppy. So we told our mom and she said they had no right to do that to us they didnt keep their promise to us. They were greedy for money cuz other people payed all the money up front and thats why we didnt get our puppy we wanted. So we just forgot about those people. If anyone knows of anyone else that has a female siberian husky puppy for a low price like under $200 near Purcell, Oklahoma cuz we like in Purcell, we’ll take it. Please help. I know this isn’t a question but we need help…. Please. If you know of anyone please comment, answer whatever you call it. Please. This means everything to us too.

Resolved Question: Is foreclosure a good idea?
heres the deal…
we are upside down in our home that is only in my husbands name and we cannot sell our house in this economy. we have had 1 offer in over a year of having it on the market. We are thinking about letting it go and taking the hit. We can afford it its just we are stuck here and want out. My husband makes 165000$ a year(in oklahoma) and has a $60000 car loan that will be paid off soon and another car loan that will be paid off soon as well.

if we let the house go we will be able to rent a nice house for a couple years and be able to buy things we have not been able to afford in the past and save money for our future ect. so just by what i have read we should be able to bounce back quickly and get a house in 5 years. (I understand that it wont fall off for 7 years) but we have termites and need the roof replaced and owe homeowner dues of 800$ so it just seems logical to take the hit. we tried a short sale with the only offer we had but our lending company wont let us do a short sale!

I simply cannot justify giving up a car that i like and that will be paid off and putting it towards a house that i dont like and that i am upside down and that will be paid off in 25 years. that just means i will have to buy another car no matter what the price and be in debt on a car again. my goal is to have everything paid off beofre i buy another house not go into debt to get rid of a house.

Activists Seek End to $640M Calif. Welfare Program for Illegals

Activists in California are pushing for a ballot initiative that would end public benefits for illegal immigrants and terminate welfare payments for their children, according to a report in The Los Angeles Times.

Organizers have kicked-off a drive to gather the 488,000 voter signatures required to qualify the measure for the June 2010 election. It has been a slow start, however, with only $350,000 in the war chest. Typically, statewide initiatives consume about $4 million at the signature-collecting phase.

Supporters of the initiative further want to challenge the citizenship of children born in the United States to parents who are here illegally, San Diego political activist Ted Hilton told the Times.

Hilton argued that the 14th Amendment states, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the State wherein they reside.”

Since illegal residents are not “subject to the jurisdiction” of the United States, their offspring should not be citizens, he maintained.

Hilton pointed to estimates that California’s 2.7 million illegal residents account for $4 billion to $6 billion (mostly schools, prison space, and emergency healthcare) of the state’s $105-billion budget.

“Are we going to continue asking taxpayers to pay for these services when the state is completely out of money?” he asked.

The measure would end state welfare to an estimated 48,000 households and 100,000 children — aid that now costs the state $640 million a year.

Hilton has been beating the drum against illegal immigration for two decades. With regard to the new initiative, his organization, Taxpayer Revolution, has gotten the seal of approval from Republican Rep. Dana Rohrabacher, the American Legion California chapter, NumbersUSA, Save Our State, and the California Coalition for Immigration Reform.

The California initiative follows similar measures in Oklahoma, Colorado Virginia, Arizona and Georgia, according to the Times report.

Meanwhile, proponents for the rights of illegal immigrants argue that illegal residents pay taxes — sales taxes on what they buy, gasoline taxes when they fuel their cars, property taxes if they own homes. The Social Security Administration estimates that in 2007, illegal residents nationwide contributed a net of 12 billion dollars to the system.

Peter Schey, a Los Angeles attorney who successfully challenged Proposition 187, a similar measure, said courts would most likely sink the initiative.

“This proposal . . . has no chance of surviving a constitutional challenge,” he told the Times. “It is plainly driven by racism and a desire to whip up xenophobia during difficult economic times for U.S. citizens.”

Proposition 187 was halted in its tracks when a federal judge ruled that the measure unconstitutionally usurped federal jurisdiction over immigration.

Mike Hethmon, an attorney with the Washington-based Immigration Reform Law Institute, told the Times that the latest measure passes muster under federal authority delegated to the states to restrict access to benefits and verify applicants’ eligibility.

Unlike Proposition 187, the new measure does not attempt to curtail access to education – keeping it square with the 1982 Supreme Court ruling that states could not bar illegal immigrant children from schools.

Some features of the initiative:

Would cut off CalWorks payments to the children of citizens or legal residents who fail to meet eligibility requirements for state aid because they are unwilling to work, addicted to drugs or absent.

Would require that applicants for birth certificates verify their legal status.

Would require that those applicant for birth certificate unable to verify their legal status produce official identification from a foreign government, a record of any publicly funded costs for delivering the child, and other information before receiving their child’s birth certificate, which would be marked with the notation “foreign parent.”

Resolved Question: Does anyone know how capital gains tax works on a home owned/occupied 18 out of the 24 months? In Oklahoma?
I need to know how much i am going to get dinged on taxes if i sell my home. I understand the 2 out of 5 years thing, but i have owned/occupied for only 18 months out of 24. I cant seem to get a clear answer out of anyone, and all I have heard is that the tax will be pro-rated. We anticipate a $50k profit, and we live in Oklahoma. Going to sell by owner and would like to put it up for sale this week. I have also read about “circumstances” that can change the amount of tax you owe if you sell early, such as health, job relocation, etc….well we just want to sell to scale down because of another child on the way. I wonder if that would count as a “life changing circumstance”. Any help on this matter is appreciated.
